Using the work of a posted worker who was not legally employed by the foreign employer (service provider) and the responsibility of the service user in Croatia

A fine in an amount from HRK 31,000.00 to HRK 60,000.00 for each alien shall be imposed for a misdemeanour by the service recipient if he knows or could have known that he was using the work of a posted worker who was not legally employed by the foreign employer. A fine in an amount from HRK 4,000.00 to HRK 6,000.00 for each alien shall be imposed for a misdemeanour on the service recipient natural person and the responsible person of the legal person.

The posted worker's right to judicial protection

For the purpose of ensuring protection and enjoyment of the rights to guaranteed working conditions, the posted worker may initiate a court procedure against a legal or natural person of the foreign employer or service recipient in the Republic of Croatia before the competent court in the Republic of Croatia, in accordance with the regulations of the Republic of Croatia. Ako pružatelj usluge s kojim imate ugovor o pružanju usluga koristi rad radnika koji nije zakonito (nema reguliran radni i boravišni status ) zaposlen u državi gdje pružatelj usluga ostvaruje poslovni nastan, kao primatelj usluge možete biti prekršajno odgovorni na način:

Novčanom kaznom od 31.000,00 do 60.000,00 kuna za svakog stranca kaznit će se za prekršaj primatelj usluge ako zna ili je mogao znati da koristi rad raspoređenog radnika koji nije zakonito zaposlen kod stranog poslodavca (članak 86. stavak 8.  Zakona o strancima), Novčanom kaznom od 4.000,00 do 6.000,00 kuna za svakog stranca za ovaj prekršaj kaznit će se primatelj usluge fizička osoba i odgovorna osoba pravne osobe.

Pravo izaslanog radnika na sudsku zaštitu zajamčenih prava

Radi zaštite i ostvarivanja prava na zajamčene uvjete rada raspoređeni radnik može protiv pravne ili fizičke osobe stranog poslodavca, odnosno primatelja usluge u Republici Hrvatskoj pokrenuti sudski postupak pred nadležnim sudom u Republici Hrvatskoj, u skladu s propisima Republike Hrvatske.
